href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/sa\/consol_reg\/arr210\/notes.html\" target=\"_blank\" rel=\"noopener noreferrer\">\u4ea4\u901a\u6cd5\u7684Obligation to give way\u8ba9\u8def\u7684\u4e49\u52a1<\/a>\uff0c\u6709\u76f8\u7576\u7684\u4ea4\u901a\u6cd5\ufffc\u8981\u6c42\u9a7e\u9a76\u4eba\u7d66\u884c\u4eba\u8ba9\u8def\u3002\u4e8b\u5b9e\u4e0a\uff0c\u5728\u67d0\u4e9b\u60c5\u51b5\u4e0b\uff0c\u53ef\u80fd\u4f1a\u8981\u6c42\u591a\u540d\u9053\u8def\u4f7f\u7528\u8005\ufffc\u4e92\u76f8\u8ba9\u8def\uff0c\u4f8b\u5982\u5728\u4ea4\u53c9\u8def\u53e3\uff0c\u6709\u8d85\u8fc7\u4e00\u4e2a\u505c\u6b62\u6216\u8ba9\u8def\u6807\u5fd7\u5728\u9053\u8def\u4e0a\u3002<!--more--><img href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/sa\/consol_reg\/arr210\/s236.html\" target=\"_blank\" rel=\"noopener noreferrer\">Australian Road Rules \u4ea4\u901a\u6cd5\u7b2c236(1)\u6761\u89c4\u5219<\/a>\uff0c\u884c\u4eba\u4e0d\u5f97\u8fdb\u5165\u9a7e\u9a76\u4eba\u7684\u9053\u8def\u800c\u9020\u6210\u4ea4\u901a\u5371\u9669\u3002<\/p>\n<p>\u5728\u8be6\u7ec6\u89e3\u91ca\u4e4b\u524d\uff0c\u6211\u5fc5\u987b\u6f84\u6e05\uff1a\u6211\u4e0d\u662f\u8bf4\u53ef\u4ee5\u6545\u610f\u649e\u6b7b\u884c\u4eba\uff0c\u800c\u662f\u8d8a\u6765\u8d8a\u591a\u5b66\u751f\u5728\u9a7e\u6821\u4e0a\u8bfe\u65f6\u5bf9\u884c\u4eba\u53cd\u5e94\u8fc7\u5927\u4f5c\u51fa\u9519\u8bef\u5224\u65ad\u4f8b\u5982\uff1a\u6025\u5239\uff0c\u6216\u5927\u5e45\u5ea6\u52a8\u65b9\u5411\u76d8\u4f5c\u51fa\u8eb2\u907f\u52a8\u4f5c\u3002<\/p>\n<p>\u7531\u4e8e\u4e49\u52a1\u7684\u6cd5\u5f8b\u539f\u5219 <a href=\"https:\/\/en.wikipedia.org\/wiki\/Duty_of_care#Australia\" target=\"_blank\" rel=\"noopener noreferrer\">legal principle of duty of care<\/a>\uff0c\u9a7e\u9a76\u4eba\u8fd8\u662f\u8981\u5c3d\u91cf\u907f\u514d\u4e0e\u884c\u4eba\u76f8\u649e\u3002\u4ed6\u4eec\u6709\u6cd5\u5f8b\u4e0a\u7684\u4e49\u52a1\uff0c\u4e0d\u80fd\u758f\u5ffd\u5927\u610f\u3002\u56e0\u6b64\uff0c\u5982\u679c\u53ef\u4ee5\u7684\u8bdd\uff0c\u9a7e\u9a76\u4eba\u5fc5\u987b\u4e3a\u5df2\u7ecf\u5728\u884c\u8f66\u9053\u7684\u884c\u4eba\u505c\u8f66\uff0c\u800c\u4e0d\u662f\u4e3a\u8def\u8fb9\u60f3\u8981\u8fc7\u9a6c\u8def\u7684\u884c\u4eba\u505c\u8f66\u3002\u8fd9\u53d6\u51b3\u4e8e\u8f66\u7684\u901f\u5ea6\u3001\u4eba\u7684\u884c\u8d70\u901f\u5ea6\u3001\u53f8\u673a\u7684\u5239\u8f66\u53cd\u5e94\u901f\u5ea6\u3001\u8f66\u8f86\u672c\u8eab\u3001\u8def\u51b5\u4ee5\u53ca\u8f66\u548c\u6b65\u884c\u8005\u4e4b\u95f4\u7684\u8ddd\u79bb\u3002<\/p>\n<p>\u540c\u65f6\uff0c\u6839\u636e<a href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/sa\/consol_reg\/arr210\/s353.html\" target=\"_blank\" rel=\"noopener noreferrer\">Australian Road Rules <\/a><a href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/sa\/consol_reg\/arr210\/s353.html\">353 \u4ea4<\/a><a href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/sa\/consol_reg\/arr210\/s353.html\" target=\"_blank\" rel=\"noopener noreferrer\">\u901a\u6cd5353\u6761<\/a>\uff0c\u5728\u5341\u5b57\u8def\u53e3\uff0c\u9a7e\u9a76\u4eba\u8f6c\u5f2f\u8fdb\u5165\u884c\u4eba\u6b63\u5728\u6a2a\u8fc7\u7684\u9053\u8def\u65f6\uff0c\u5fc5\u987b\u7ed9\u884c\u4eba\u8ba9\u8def\u3002 href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/sa\/consol_reg\/arr210\/s230.html\" target=\"_blank\" rel=\"noopener noreferrer\">Australian Road Rules 230 \u4ea4\u901a\u6cd5230\u6761<\/a>, \u884c\u4eba\u5728\u6ca1\u6709\u6807\u793a\u7684\u4ea4\u53c9\u8def\u53e3\u7684\u5730\u65b9\uff0c\u8981\u5c3d\u53ef\u80fd\u8d70\u6700\u77ed\u7684\u8def\u7ebf\u8fc7\u9a6c\u8def\u3002\u4e0d\u8981\u5728\u8f66\u6d41\u4e2d\u7eb5\u6a2a\u4ea4\u9519\uff0c\u4e5f\u4e0d\u8981\u659c\u7740\u8fc7\u9a6c\u8def\uff0c\u56e0\u4e3a\u5728\u9053\u8def\u4e0a\u505c\u7559\u7684\u65f6\u95f4\u8d85\u8fc7\u5fc5\u8981\u7684\u65f6\u95f4\u662f\u8fdd\u6cd5\u884c\u4e3a\u3002<\/li>\n<\/ul>\n<ul>\n<li>\u6839\u636e<a href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/sa\/consol_reg\/arr210\/s234.html\" target=\"_blank\" rel=\"noopener noreferrer\">Australian Road Rules 234 \u4ea4\u901a\u6cd5234\u6761<\/a>\uff0c\u884c\u4eba\u5982\u679c\u572820\u7c73\u4e4b\u5185\u9047\u5230\u6709\u6807\u793a\u7684\u4eba\u884c\u6a2a\u9053\uff0c\u5c31\u5fc5\u987b\u4f7f\u7528\u5b83\u6a2a\u8fc7\u9a6c\u8def\u3002\u5728\u6307\u5b9a\u4eba\u884c\u6a2a\u905320\u7c73\u5185\uff0c\u4e71\u8fc7\u9a6c\u8def\u662f\u8fdd\u6cd5\u7684\u3002<\/li>\n<\/ul>\n<p>\u884c\u4eba\u65e0\u8bba\u662f\u5426\u5728\u6307\u5b9a\u7684\u4eba\u884c\u6a2a\u9053\u4e0a\u90fd\u5fc5\u987b\u786e\u4fdd100%\u9053\u8def\u662f\u7545\u901a\u7684\uff0c\u5e76\u4e14\u80fd\u591f\u88ab\u9a7e\u8f66\u8005\u770b\u5230\u3002 \u5728\u6709\u4e2d\u95f4\u5e26\u7684\u8f83\u5bbd\u7684\u9053\u8def\u4e0a\uff0c\u884c\u4eba\u53ef\u4ee5\u52062\u4e2a\u9636\u6bb5\u8fc7\u9a6c\u8def\uff0c\u5229\u7528\u4e2d\u95f4\u5e26\u518d\u6b21\u68c0\u67e5\u4ea4\u901a\u60c5\u51b5\u3002<\/p>\n<p>\u5907\u6ce8\uff1a<\/p>\n<p>\u6839\u64da<a href=\"http:\/\/www5.austlii.edu.au\/au\/legis\/sa\/consol_reg\/arr210\/s18.html\" target=\"_blank\" rel=\"noopener noreferrer\">Australian Road Rules 18 \u4ea4\u901a\u6cd518\u6761<\/a>\uff0c\u9019\u7bc7\u6587\u7ae0\u6240\u8aaa\u7684\u884c\u4eba\u5305\u62ec :<\/p>\n<ul>\n<li>(a) \u9a7e\u9a76\u65f6\u901f\u4e0d\u80fd\u8d85\u8fc710\u516c\u91cc\u7684\u673a\u52a8\u8f6e\u6905\u7684\u4eba(\u5728\u5e73\u5730\u4e0a)\uff1b\u4ee5\u53ca<\/li>\n<\/ul>\n<ul>\n<li>(b) \u5750\u975e\u673a\u52a8\u8f6e\u6905\u7684\u4eba\uff1b\u4ee5\u53ca<\/li>\n<\/ul>\n<ul>\n<li>(c) \u63a8\u7740\u673a\u52a8\u6216\u975e\u673a\u52a8\u8f6e\u6905\u7684\u4eba\uff1b\u4ee5\u53ca<\/li>\n<\/ul>\n<ul>\n<li>(d) \u5728\u8f6e\u5f0f\u5a31\u4e50\u88c5\u7f6e\u6216\u8f6e\u5f0f\u73a9\u5177\u5185\u6216\u5728\u5176\u4e0a\u7684\u4eba\u3002<\/li>\n<\/ul>\n<p>\u53c2\u8003\u8d44\u6599 \ufffcReference:<\/p>\n<ul>\n<li>Under s 87 of the Road Traffic Act 1961 (SA) it is an offence to walk without reasonable regard for other road users.<\/li>\n<li>Under the rules 230 and 234 of the Australian Road Rules it is an offence for a pedestrian to cross a road diagonally, unless at an intersection where this is allowed.<\/li>\n<li>It is an offence under regulation 23A of the Road Traffic (Road Rules &#8212; Ancillary and Miscellaneous Provisions) Regulations 1999 (SA) (and rule 234 of the Australian Road Rules) to cross to or from an area of road within 20 metres of a tram stop other than at a pedestrian crossing.<\/li>\n<li>It is an offence to cross a road within 20 metres of a pedestrian crossing at a place other than the pedestrian crossing (rule 234 of the Australian Road Rules).<\/li>\n<li>Rule 230 states that a pedestrian must cross a road by the shortest safest route and under rule 232 they can only cross when the pedestrian lights are
